These terms govern your access to and use of LuneaPMS products, services, and digital content. Effective Date: 1 June 2026.

1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the products, services, websites, applications, and digital content ("Services") made available by LuneaPMS ("LuneaPMS", "we", "us", or "our"), operating at luneapms.com.

By purchasing, downloading, or accessing any LuneaPMS product or Service, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

By placing an order, completing a purchase, submitting your email address for a free product, or otherwise using the Platform or any Digital Product, you confirm that:

4.1 Nature of Products

LuneaPMS offers Digital Products including guides, protocols, workbooks, web applications, and Notion workspaces. All products are delivered electronically. No physical goods will be dispatched unless separately and expressly stated.

4.2 Delivery

Digital Products are delivered via email and/or download link immediately upon confirmed payment through our third-party payment processor (currently Gumroad). It is your responsibility to ensure the email address provided at checkout is accurate and able to receive delivery emails.

LuneaPMS accepts no responsibility for failed delivery resulting from incorrect contact details, spam filtering, or issues with your email or internet service provider.

4.3 Availability

We reserve the right to modify, discontinue, or withdraw any Digital Product at any time. In the event that a product you have purchased is discontinued, we will endeavour to provide equivalent replacement content where reasonably practicable.

5. Payment Terms

All purchases are processed through Gumroad, our third-party payment processor. By completing a transaction, you also agree to Gumroad's applicable terms of service and privacy policy.

All prices are listed in Australian Dollars (AUD) or United States Dollars (USD) as indicated on the applicable product page. LuneaPMS reserves the right to change pricing at any time without prior notice, except in respect of orders already placed and confirmed.

By providing payment information and completing a purchase, you represent and warrant that you are authorised to use the payment method provided.

6. Refund Policy

6.1 No Change-of-Mind Refunds

Due to the immediately accessible, downloadable, and non-returnable nature of our Digital Products, LuneaPMS does not offer refunds for change of mind once a Digital Product has been accessed, downloaded, or delivered.

By completing a purchase, you expressly acknowledge and consent to immediate delivery of the digital content and accordingly waive any cooling-off or change-of-mind refund rights that may otherwise apply under applicable law, to the maximum extent permitted by law.

6.2 No Refunds for Dissatisfaction With Results

LuneaPMS Digital Products provide information, protocols, tools, and frameworks for personal wellbeing management. Individual results will vary. LuneaPMS does not guarantee any specific health, wellness, or personal outcome. Dissatisfaction with personal results does not entitle a Customer to a refund.

6.3 Australian Consumer Law Guarantees (Non-Excludable)

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (ACL) or any other applicable Australian legislation that cannot lawfully be excluded or limited.

If our Digital Products are found not to be of acceptable quality or do not match their description, you may be entitled to a remedy under the ACL. Please contact us at info@luneapms.com to discuss your situation.

6.4 Requesting a Remedy

If you believe you are entitled to a remedy under the ACL, please contact us within 30 days of purchase at info@luneapms.com with your order details and a description of the issue. We will assess your request and respond within 5 business days.

7. Intellectual Property

7.1 Ownership

All content, materials, text, graphics, data, designs, frameworks, protocols, tools, applications, source code, and other intellectual property comprised in or associated with LuneaPMS Digital Products and the Platform ("IP") are owned by or licensed to LuneaPMS and are protected by Australian and international intellectual property laws.

7.2 Permitted Use Licence

Upon purchase and subject to these Terms, LuneaPMS grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable licence to access and use the purchased Digital Product solely for your own personal, non-commercial use.

7.3 Restrictions

You must not, without our express prior written consent:

8. Health & Wellness Disclaimer

8.1 Not Medical Advice

LuneaPMS Digital Products are designed to provide general wellbeing information and self-management tools only. All content is intended for informational and educational purposes and does not constitute medical advice, diagnosis, treatment, or a substitute for consultation with a qualified medical professional.

Nothing in any LuneaPMS Digital Product is intended to diagnose, treat, cure, or prevent any medical condition, illness, or disease.

8.2 Consult Your Doctor

Before making any changes to your diet, supplement regimen, exercise routine, or medication, you should seek the advice of a qualified healthcare practitioner. If you have or suspect you have a medical condition, or if you are pregnant or breastfeeding, always consult your doctor before using any protocol or supplement information contained in our products.

8.3 TGA Compliance

LuneaPMS does not make any therapeutic claims with respect to its products. References to supplements, nutritional strategies, or lifestyle protocols are provided as general wellbeing information only, consistent with guidance from the Therapeutic Goods Administration (TGA).

8.4 Individual Results

All testimonials, case studies, and results referenced in LuneaPMS materials reflect individual experiences and are not representative of results that every customer will achieve. Individual outcomes depend on a wide range of personal factors.

9. Third-Party Platforms & Services

LuneaPMS uses third-party platforms to deliver products and services, including Gumroad (payment and delivery), Klaviyo (email marketing), Notion (workspace templates), and Vercel (hosted applications). Your use of these platforms is subject to their respective terms of service and privacy policies, which you should review independently.

LuneaPMS is not responsible for the availability, accuracy, or security of third-party platforms, or for any loss or damage arising from your use of them.

10. Limitation of Liability

10.1 Exclusion of Consequential Loss

To the maximum extent permitted by applicable law, LuneaPMS, its officers, employees, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, health outcomes, or other intangible losses, arising out of or in connection with your use of our Services or Digital Products.

10.2 Cap on Liability

To the maximum extent permitted by applicable law, our total aggregate liability to you in respect of any claim arising out of or in connection with these Terms or your use of our Services will not exceed the total amount paid by you to LuneaPMS in the 3 months immediately preceding the event giving rise to the claim.

10.3 Consumer Law Savings

Nothing in clauses 10.1 or 10.2 limits or excludes any liability that cannot be limited or excluded under the ACL or any other applicable law.

The collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms and is incorporated herein by reference. A copy of the Privacy Policy is available at luneapms.com/privacy.

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

13.2 International Customers

If you are accessing our Services from outside Australia (including from the United States), you do so at your own risk and are responsible for compliance with the laws of your local jurisdiction. LuneaPMS does not represent that the Services are appropriate or lawful for use in all jurisdictions.

13.3 Dispute Resolution

Before commencing any legal proceeding, we encourage you to contact us at info@luneapms.com to attempt to resolve any dispute informally. We commit to responding within 10 business days.

14. Changes to These Terms

LuneaPMS reserves the right to update or modify these Terms at any time. The updated Terms will be posted on our Platform with the revised effective date. Your continued use of the Services following any such update constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
